Welcome to Klik NZ (“we”, “us”, “our”). By accessing or using our website (klik.co.nz), placing an order, or interacting with our services, you agree to be bound by these Terms of Service and all applicable New Zealand laws, including the Consumer Guarantees Act 1993 and the Fair Trading Act 1986.

If you do not agree to these Terms, please do not use our website.

  • Not attempt to disrupt, damage, or gain unauthorised access to the site
  • Not engage in fraudulent, abusive, or harmful behaviour

We aim to provide accurate product information, images, and pricing.
However:

  • Errors may occur (including typographical mistakes, product inaccuracies, or pricing errors)
  • We reserve the right to correct errors at any time

If an error affects your order, we will contact you and give you the option to proceed, modify, or cancel the order.

This complies with the Fair Trading Act requirements around accurate representation.

3. Orders, Payments & Availability

When placing an order:

  • All orders are subject to availability
  • Prices are shown in NZD and include/exclude GST depending on your website setup
  • Payment must be received in full before your order is processed or shipped
  • We reserve the right to limit or refuse any order (e.g., suspected fraud)

You agree to provide accurate billing, shipping, and contact information.

If an item becomes unavailable after purchase, we will offer:

✔️ a backorder option, or
✔️ a full refund.

This complies with the Contract and Commercial Law Act.

4. Shipping, Delivery & Returns

By placing an order, you acknowledge and agree to our:

These policies form part of these Terms of Service.

Delivery times are estimates only. Delays caused by couriers, customs, weather, or other external factors are outside our control, but we will always assist where possible.

All refunds, repairs, and replacements are handled strictly in line with the Consumer Guarantees Act (CGA).

5. Consumer Rights (Important for NZ Compliance)

Nothing in these Terms is intended to:

❌ Limit your rights under the Consumer Guarantees Act
❌ Exclude guarantees related to acceptable quality, fitness for purpose, or product description
❌ Mislead consumers (Fair Trading Act compliance)

If a product is faulty, unsafe, or not as described, you may be entitled to a repair, replacement, or refund under NZ law.

6. Intellectual Property

All content on klik.co.nz—including logos, product images, graphics, text, branding, and website layout—is the property of Klik NZ or our licensors.

You may not copy, reproduce, modify, distribute, or use any content without our prior written permission.

7. Prohibited Activities

You agree not to:

  • Use the site for fraudulent or harmful purposes
  • Interfere with the security or performance of the site
  • Use automated tools (bots/scrapers) without permission
  • Upload viruses, malicious code, or harmful files
  • Misrepresent your identity or attempt unauthorised access

Breach of this section may result in termination of service and/or legal action.

8. Limitation of Liability

To the extent permitted by New Zealand law:

  • Klik NZ is not liable for indirect, incidental, or consequential losses, including lost profits, data loss, or business interruption
  • Our liability is limited to the value of the product or service purchased

However — we cannot exclude liability where the Consumer Guarantees Act applies.
This clause has been rewritten to be legal in NZ.

9. Third-Party Services

We may use third-party tools or services (such as couriers, payment gateways, analytics tools).
By using our site, you acknowledge that:

  • These providers may have their own terms and policies
  • We are not responsible for their actions, errors, or service quality

However, we take reasonable steps to work with reputable and compliant providers.

10. Account Information & Security

If you create an account:

  • You are responsible for maintaining the confidentiality of your login details
  • You must notify us immediately of any suspected unauthorised access

We are not liable for losses arising from unauthorised account use, unless caused by our negligence.

12. Governing Law

These Terms of Service are governed by the laws of New Zealand.
